High Court’s Decision in Corrib Gas Controversy
Last Wednesday’s High Court decision by Justice Mary Laffoy to grant an application by Shell to drop their permanent injunction against the Rossport 5 appears to have vindicated the legal stance taken by local landowners in North Mayo over 2 years ago.
The application was granted subject to the conditions that costs be awarded to local landowners and that compulsory acquisition orders (CAOs) against the landowners involved be dropped. Shell is now required to pay approximately €1 million in costs.
Justice Laffoy’s ruling means that the original pipeline route through Rossport, for which Shell had obtained CAOs in its construction, cannot now be continued and has no legal validity. The only way in which the pipeline can proceed is with the consent of the landowners. Legal questions to do with the pipeline and wider project remain before the High Court.
Shell was applying to drop the permanent injunction against several local landowners following on from its decision in September 2005, in the wake of considerable public protest, to agree to drop an interlocutory (temporary) injunction, which has resulted in the jailing of the Rossport 5.
However, local landowners in Rossport objected to the injunction being dropped on the basis that evidence should be presented that vindicated the original application as its imposition resulted in the men serving over 90 days in prison.
Late last year Green Party endorsed Senate Candidate, Martin Hogan, put forward a motion subsequently adopted by the party that calls for the complete renegotiation of the original Corrib gas deal. According to Mr. Hogan, “following on from Justice Laffoy’s ruling, the entire basis of the hastily arranged legislation under which the Irish people receive no royalties whatsoever for the gas and oil off the Irish coast must be reexamined. This ruling will I trust help to galvanise political will into renegotiating the deal.”0 commenti 960 giorni

Hi Martin watsup. A quick message about the *mass public meeting* on the campaign tackle Ireland's contribution to climate change.
On Saturday October 20th at 1.30pm, students and others from all over Ireland will gather in Trinity College for a public gathering, about action to tackle Ireland's greenhouse gas emissions.
Basically we're getting together students and others from all over the country who care about this issue for a historic event -Ireland's first mass gethering of students on what is probably the most important issue in the world. We'll launch a nation-wide campaign for action on this issue, and we are supported by groups like Friends of the Earth and others.
This campaign is already making progress - last week our demands were debated in Seanad Eireann. But we need to build a massive movement movement to keep on the pressure.
