	Hi everyone, We got the result back form the Environment Court last week. In short "The appeal is declined". The Judge agreed that the commissioners made the decision the wrong way, but they still made the right decision. We're all a bit shocked at the moment, but we think it might be good to have some sort of gathering for a bit of closure. Not a depressing thing, more like a party. Keep in contact, I'll talk to you more about a party later.

	Kia Ora Koutou The BGI Spinks Youth Café Project will be taking an appeal to the environments court in 2008. Yay! This is our last avenue to fully have the projects merits and the voice of young people heard in a relevant and non-tokenistic way. The appeal hearing is scheduled for Feb at this point and the Environments court will confirm the exact date when they have confirmed their court schedule. We a new lawyer Tom Bennion. Who will be taking over from Jim Lynch. We are also thankful to Jim for all his hard work and for setting the case up in a good position to go forward. If you spoke or gave any evidence at the hearing can you send it through to me. We need it by Dec 10th so we can sit down with Tom and prepare the case and make any last minute adjustments. · And can you let me know if you are available around the hearing time i.e. Feb 2008. You are all integral to this appeal so we need to make sure you are available. Awesome, so onwards and upwards everyone! Feb 2008 is the our time to shine so lets all do our best to make this project work for the young people of Wellington.

	In 2000 a group of 1000 young people in Wellington & Lower Hutt conducted research into youth needs in their city. The research project found that 69% of young people in Wellington feel that the community doesn't care about them and that the best action to counter this would be to have a space available for young people to feel safe and welcomed. A space was offered by the church involved a new basement level being built under a heritage cottage on the church's site. This new level would house a café, run for and by youth. The youth team decided that raising the building for a new level was the best way to preserve the cottage's historic values, as it is not in it's original location but it's third. A conservation report was obtained prior to the design being confirmed to ensure that heritage values were respected. In April 2007 the recourse consent case for building the café was heard. Consent was declined. Commissioners felt that because a café is a permitted activity in the inner city, the evidence regarding the need and benefit to youth and the city can be ignored in their decision making process. They also concluded that it unfair to "submerge the interests of the wider community [preserving old buildings] to the interests of Wellington youth". It is worth noting that very few people know of Spinks by name and that neither Spinks cottage or St John's (the church kind enough to allow this project) is featured on the Historic Place's website. The decision has left the team feeling, that old buildings are more important than young people and that youth opinions and needs shouldn't be considered as part of the wider communities needs.
